1. PROVISION OF SERVICES
1.1. The analysis provided by BabyDNA Paternity Test Services is for the use of the Client ordering the test.
1.2. BabyDNA Paternity Test Services makes no representation, expressed or implied, that the result of the analysis is useful or purposeful for any other purposes other than information.
2. COMPANY’S RESPONSIBILITIES
2.1. BabyDNA will send all kits to the Client via Standard Postal mail, unless otherwise requested by the client. Dates advised by BabyDNA for the completion of analysis and reporting of results are for guidance and cannot be held responsible for any delays caused by the postal system. Client need to notify BabyDNA of failure to receive kit after 4 days.
2.2. The turnaround times stated by BabyDNA commence from the receipt of the samples at the laboratory and not from the receipt of the samples at any administration office or company agent.
2.3. The Client will indemnify BabyDNA from any liabilities in connection with the test and its results, as the Client understands that as BabyDNA endeavours to perform its testing to her highest standard of accuracy, as with any testing there is a possibility of error or omission. In the event of the Client claim for damages from BabyDNA whether negligent or otherwise, BabyDNA’s liability shall not exceed the cost paid for the test and agrees to keep BabyDNA and its agents, officers and employees harmless from all further claims or damages
2.4. The Client should notify BabyDNA of any error or omission within thirty days of the test report via email or postal mail. BabyDNA’s liability shall not exceed the cost paid for the test.
2.5. BabyDNA shall not be liable for any loss or damage suffered by the Client or any other person as a consequence of reporting the test results to the Client ordering the services or other authorised persons.
3. CLIENT’S RESPONSIBILITIES
3.1. The Client is responsible for ensuring that the biological samples passed to BabyDNA for analysis are legally entitled to possess and obtain. And accept to cover BabyDNA for any loss or damage that they may suffer as a result of the samples not having been obtained legally.
3.2. The Client undertakes that all information provided to BabyDNA for the purpose of ordering the Service is correct.
3.3. The Client undertakes that and that any credit/debit card used to pay for the Service is owned by them or that they have the owner’s authority to use it to pay for the Service.
3.4. The Client warrants that they are entitled to provide BabyDNA with all information and data and shall indemnify BabyDNA against any claims for infringement of the information or data, breaches of confidentiality or failure to comply with any data protection laws brought by any third parties.
3.5. BabyDNA shall not be liable for any failure to provide accurate, complete or other form of test results due to insufficient, incomplete or poor quality of specimen.
3.6. The Client should only enter into contract with BabyDNA if they are willing to be bound by these terms and conditions.
4. SALES AND CANCELLATION
4.1. Refunds will not be issued as all sales are final.
4.2. The Client's order account is good for three months, and samples has to be sent back to BabyDNA from the date of order. If the Client fails to send the samples within this time frame, the order will be closed.
